1. Acceptance of Terms
These Terms govern your use of siloampoolcare.com and all residential pool services provided by Siloam Pool Care, LLC (“Company”).
By scheduling, receiving, or paying for service, or submitting any agreement electronically, you agree to these Terms, the Privacy Policy, and the Residential Service Agreement, all of which are incorporated by reference.
2. Services
Company provides residential-only pool cleaning, maintenance, and repair services. Services may include water testing, chemical balancing, cleaning, inspections, and digital service reporting.
Company may refuse or suspend service due to unsafe conditions, restricted access, unpaid balances, weather, or circumstances beyond Company control.
3. Pricing
All service pricing is published at https://www.siloampoolcare.com and may change at any time. Pricing in effect at the time of service applies.
4. Client Responsibilities
Client shall:
- Provide unlocked, safe, and unobstructed access
- Maintain proper water level
- Secure pets on service days
- Keep equipment accessible
- Disclose hazards or equipment issues
Company is not responsible for missed, delayed, or incomplete service caused by access or safety issues.
5. Missed Service / Locked Access
If Company cannot access the pool or equipment due to locked gates, restrained access, pets, or hazards, the visit is considered completed for billing purposes. No credits or make-up visits are guaranteed.
6. Photo & Video Consent
Client automatically grants Company permission to photograph and video record the pool, equipment, and work performed.
Client grants Company a perpetual, royalty-free, irrevocable license to use this media for:
- Service reports
- Website and Google listings
- Social media and advertising
- Marketing and promotional use
Company will avoid intentionally capturing people but is not responsible for incidental capture.
7. Weather & Holiday Policy
Service schedules may be adjusted due to:
- Rain, wind, extreme heat, smoke, or unsafe conditions
- Holidays or route changes
Missed visits due to weather or holidays do not qualify for credits. Service will resume on the next scheduled visit.
8. Assumption of Risk
Pool service involves inherent risks. Client assumes all risks related to normal service activities.
9. Limitation of Liability
Company’s total liability is limited to the amount paid by Client during the applicable billing period. Company is not liable for indirect or consequential damages.
10. Indemnification
Client agrees to hold Company harmless from claims arising from unsafe property conditions, Client negligence, or violation of these Terms.
11. Governing Law & Arbitration
These Terms are governed by California law. Disputes shall be resolved by binding arbitration in California.
12. Updates
Company may update these Terms at any time. Continued service constitutes acceptance.
